I think it's more accurate to say you hope somebody in a position to take liability for it will agree it is that. I see very little prospect of that given that you're probably wrong, you have no evidence or compelling argument in your favour and it's not in their interests to agree with you.Doing some more googling on this it seems one problem with the 1.6 is water getting into the bores through faulty head gaskets when the engine is cold. This would tie in with the OP's coolant loss and the engine failing on a cold start. Maybe hydraulic lock as a piston reached TDC = smashed piston. It may need an independent expert to assess and report though but perhaps it's an avenue to explore.
