After travelling 4 hours to see a car I left £50 deposit and asked for a BMW inspection (£145 + VAT). HPI at £40.

The dealer inspected the car and did a report which should have been posted to me but they passed it to the owner.

The seller today comes back and tells me the car was in an accient last night and his "mate" is doing the repairs - no thanks.

Seller is returning my £50. What annoys me is I'm losing out on £200!!! Should I tell my Visa card company that I never seen the report done by the dealership? As I haven't - they had a BRIEF chat over the phone and couldn't tell me much as the owner had their report. It was the seller who read the report out to me but I wouldn't know for sure if it was 100% truth.

I'd get a refund from the dealer personally. They've buggered it up.

It seems the seller was good friends with the service manager at the dealership. I requested the garage phoned me on my mobile after the inspection but the seller did, armed with MY report. I think if the seller wants to know what is wrong with the car he either:

Waits for me to disclose the report
Pays for his own inspection

Personally I think he has gone away with the report and sold the car to someone else. Some BS story about him having it checked over to make sure it was ok to sell.

Oh and forgot to say that the sellers sister works at the BMW dealership!!!!

Tell the credit cars company and say that you've not had the service you ordered. Put everything in writing to protect yourself.

Stick with it because after loads of hassle with XXXXXXcard some time ago over an inspection on a Dino 308 GT4, I eventually got a refund from the credit card company.

In my case, the car was inspected and I was warned off it verbally by the inspector. The report never arrived and the inspector tried to buy the car for his own company a couple of days later!

I bought it anyway....

Spoken with BMW head office and didn't really get anywhere. They said it was for me to battle it out with the seller! Expecting a call from the dealership.

Also head office couldn't find a record of the car. I'm wondering if the car has been regular serviced - if the dealership don't have a record then it appears the service history is fraudulent.

Could be, if the guy has a friend or relative at the dealership.

Just spoken to Barclaycard and I can't do anything until the 26th! They also said it would be very difficult to claim funds back as it was a verbal conversation (dealer might say I said it was ok to pass report on) and no evidence!!

Too true! I'm just annoyed as this is now the second time waster I've had who has cost me money. All I want to do is buy a nice car - who thought it would be so difficult?!

Irrelevant, do not dwell on this "evidence" or lack there of, you paid for a report that you did not recieve, demand your money.

Complained again to BMW and told them of the back handers going on. They had contacted the service manager at the dealership yesterday and told him to phone me - he didn't. BMW are going to contact the service manager again but overall not very good. They recommended I take legal advice but something that they are unable to assist me with.

Just spoken to the service manager at the dealership. This was the guy I spoken to on Saturday morning and made payment to.

Ok...

I argued that the owner shouldn't have had the report first. He said that they always give a copy of the report to the owner and I never asked them not to provide one. My copy is in the post it seems.

I asked the service manager (9am) to phone me on my mobile as soon as the report was done. At 11am the owner called me first with the report. I then had to phone the garage who didn't have the report as the owner had it - they forgot to tell me the hard copy was downstairs on it's way up. The service manager also said he didn't hear me ask I wanted them to phone me straight after. I said since that was the case are you going to refund and nope they aren't. The service manager said he was stood 10 feet away from the owner when the report was read out and I asked did you hear every word he said. How would I know he told the truth? Answer was he couldn't confirm that as dealing with other customers.

Since the owner told me he was good friends with the service manager - the service manager denies ever meeting the owner before. Funny that, as he KNOWS the owners sister works at the partner company (but reckons he hasn't ever met her).

The service manager strongly denies any fraudulent history as the stamps are locked up. BMW wouldn't allow mechanics to service cars on back handers in their own time. I wonder...

Looks like I'm going to end up paying the inspection. Another lesson learned...

Received a cheque just now from the owner covering my cash deposit. Going to pay this in ASAP.

He NEVER arranged this with me until Sunday so would have posted out Monday. However the dealership posted out their report (so they say) on Saturday and I haven't received that yet!
