You've made the wrong decision exactly as Magic919 says.
Your son doesn't have an insurer. His losses aren't covered under his policy as he's TPFT so they've handed it to a Credit Hire company. Probably Plantec or BLD. All they'll want to do is drag out the hire bike as much as possible so they can line their own pockets at a silly daily hire rate. However, as they probably won't get paid the full amount and your son will sign a credit agreement for the loan of the hire bike then he could well end up with a bill for the difference from the hire bike company.
It's also highly likely that the bike will be written off now irrespective of how many second hand parts you use as this is more cost effective under the principle of mitigation.
If you use the driver's insurer then they will let you sort it how you want as they can get you a hire bike for a fraction of the cost of what your son's "insurer" will charge.

Your insurance company can not claim for uninsured losses, you have only subrogated your insured rights amd losses to them ie your car. All i know is, i didn't claim, but i got a cheque. Maybe my insurance company claimed on my behalf? Is that so unusual?
My memory is hazy, but i do know i didn't chase it myself and was angry about it at the time. Not so angry that i tore up the cheque though.

You are the only person who can claim for any uninsured losses be they general or special damages. No insurer will simply send you a cheque on spec. It has no legal basis at all and you could simply bank the cheque and then come back and claim anyway. The idea that it was "without prejudice" is laughable, not least as if they did send you this then it would be completely with prejudice so that it prejudiced your right to make any further claim for injury.
Seriously, you need to stop now.

We have cancelled the accident management company who his insurance passed him on to and are letting the other guys insurance deal with it.
As it happens they are organising a replacement bike and repair through BLD exactly the same company as the accident management company were. The main difference is that they are organising the hire of the bike on a day rate and it wont be a credit hire.
What a minefield insurance is these days, was a lot easier in my day

BLD came and collected his bike today and dropped him off a bike. He was not very impressed that they gave him a 125cc scooter. They said they did not have any geared bikes available but would swap it for one when they had.(we shall see) Funny how you are not allowed to have a better bike than the one you had but they can give you a inferior one. Still, will get him to work ok. just not any good for going to the greasy biker cafe with your mates
Said should have assessed on Monday so should know pretty soon what will be happening (probably be beyond economic repair)

3rd party's insurance company rang on Monday, it was a close call to repair or Cat C but they chose to Cat C. Offered him £1500 for bike or £1085 and he keeps bike. He paid £500 for bike, although he took a chance as it needed some work doing and had no MOT
He has had the bike back today as it will make good spares to go with the other 5 bikes in various stages he brought as a job lot a couple of weeks ago or to put back on the road.
In the job lot of bikes was one that only took a bit to get through the MOT and is a very tidy bike (a lot better than his old one was) so he does not need to get the accident damaged one back on the road desperately.
One thing I can't seem to find out is that if a Cat C bike needs a VIC check or not? I know a car does but have read that a bike doesn't can anyone clarify this please
