It's a play on words that is associated with what I do. I'll just use the version with 'and' but don't want anyone using something identical, but with an '&', that's all. If you trade marked X & Y for your business and establised a trading brand accordingly then, further down the line someone comes along directly competing with you using the brand X and Y then you could protect your trademank on the basis theirs infringes on yours as it is confusingly similar. Look at the Tort of 'Passing off'
