I know there's a couple of folk up on this here...

Say I see an advert/site online for home improvements, an all trades type outfit (Company A) doing boilers, windows, roofing etc. I send an email enquiry. I then get a response from another company altogether (Company B), who obviously have my email address and any other details I provided to Company A.

Company A is essentially a lead generation firm passing out leads (and personal data) to whoever will pay for them. I assume this is legal now, will it remain legal later this year?

Depends on the disclaimers about how they will use your data. Company A will have to change their Privacy Policy quite a bit but Company B won't change that much. It won't become illegal but it'll be harder for businesses like this to comply completely.

I am no expert but I have just sat through a webinar on GDPR so as far as I understand it that as soon as any company contacts you electronically with a marketing message post GDPR which is 28th May, i think, they will have to have your consent for them to contact you. The days of opt in boxes etc are coming to an end. So if either Company A or B contact with obtaining your consent first they will be in breach of the regulation.

The opt-in boxes will be how they manage and maintain the permission to contact you (and through which channels).

GDPR is focused on what data is held by organisations about you, also worth having any read up on PECR.

Thanks. So in my example say we believe company B is breaking the rules what is the position for the individual? Is there a complaints body? If I've been called say 10 times and it's wasted my time is there any sort of recourse? Or are we waiting for a big case to hit the headlines/courts?

This isn't me out for a bit of compo btw! A business I'm involved with is in an industry where this type of thing is commonplace. Anything that helps put the shysters out of business or at least levels the playing field is good news for us.
