I have a friend who has a young family who is renting a property, has been given a notice to move out on 28th August as the landlord has sold the property.

However, he has found a new property to move in, BUT it won't be ready until 14th Sept, so they will be virtually be homeless between 28th to 13th Sept - what is the tenant's rights? Should they stay at the current property until 13th Sept ? Or should they move out on a binding contract that they were given the notice to move out.

I dont want them to end up homeless...

Please advise ?

When were they given the notice?

If it was before the 28th July, then they're stuffed.

They were given 2 months to move out of the current property on 28th August.

as long as he had abided by the terms of the contract (notice period etc) they have to move out.

I'm sure they can find temporary accomodation, or move in with friends.

EDIT: D'oh, so the out date is 28th Aug and they were served that on the 28th June?

Why on earth didnt they start looking for a property earlier and decide on a property that was available by the 28th Aug?

Assuming they cant bunk down with friends/relatives for 2 weeks, and I am NOT recommending this (and bang would go his landlord's references etc), but if he refused to move out on the 28th August, the landlord would have to apply to the Courts (I would assume under Accelerated Possession, taking a MINUMUM of 2 weeks, but more likely 3 - 4 weeks) to get them out of the old place wink

He's not one of my tenants is he? scratchchin

Good suggestion, but I think this is better .....



Rent him your house for two weeks.

You move out and spend the rent received on a trip to the Sun for those two weeks.

Yes I was going to say the same thing...he wouldn't have chance to evict them in that time.

When is the sale actually completing? Can your friend talk to the landlord? The landlord has probably hedged his bets on getting vacant possession and may well be happy for them to stay and pay for an additional two weeks.

Assuming it's a shorthold tenancy the landlord needs to have given them two months notice ending on the date of the tenancy so presumably they signed the tenancy agreement on the 28th or 29th of a month? Otherwise they might have gained themselves a bit more time.

I'd talk to the landlord.

Why not ask the landlord if there is any leeway on when they vacate the property, he may have allowed a bit of flexibility in his planning even if the tenants have not.
