I'd make it valid until I was confident my employee could spell properly

An employer can put any stipulation into a contract as long as the stipulation is not illegal (like forcing you to rob a bank once a month, or inisisting that you assist him in a money laundering scheme).

If you don't like a particular term in a contract, you don't have to agree to the contract or sign it. Obviously, the chances of being offered a job with that particular employer will diminish accordingly.

It may be ageist, but it's not illegal - yet. There are new anti age-discrimination laws coming into effect in April. However, having compuslory retirement at "lowish" ages for some occupations will still be allowed.
