Had a prang!

I was thinking just yesterday that I've not had any accidents except one non fault one in 25 yrs of driving.

Then this morning a lorry starts to pull into the inner lane whilst I'm beside him.
I had no choice but to brake hard to avoid impact.

Trouble is the lady behind me didn't manage to stop & slammed into the back of my van smashing up the rear side panel bumper & light.

Not her fault really & I apologised to her but she was ok with it & gave me her name address & numbers.
A lot of people would have gone off on one at me no doubt but she was quite sweet & took it well.

I know the company the lorry belongs to but didnt have time to note the reg number.

Question is who should I pursue, the lorry or the lady who hit me.
I kinda feel bad about pursuing her as it wasn't really down to her.

Thought appreciated pls.

From an insurance company POV I would think that it's her fault for not leaving enough distance or concentrating enough

So the damage, was it limited to the bumper and lights - or did she smash your back doors in?

Her fault I'm afraid. Lorry driver, while a tool and perhaps guilty of DWDCAA, didn't hit you.

Lady 100%

Wouldn't have happened if lorry driver wasn't being an arse but no damage did happen directly.

If lady left more space wouldn't have happened - did happen so her fault.

There was no impact between you and the lorry, so you can't make a claim against them no matter how inconsiderate a driver he/she was.

The lady drove into you from behind, so by definition, wasn't maintaining a sufficient braking distance and had little right to be p'eed off at you anyway. I always thought that if you are rear-ended it's almost always gonna come off as their fault.

OP, I can understand you not wanting to pursue the woman that hit you, but console yourself with the fact it will be her insurance company that pays. I don't think you'll get far chasing the lorry driver for an accident he didn't have.

It was very very almost lorry.

Assuming you just hit the anchors and went backwards in your lane rather than changed lanes etc.

Women who hit you.

Straight forward blame, she either didn't leave enough room or wasn't concentrating enough.

Pretty much. Only example I can think of where it wouldn't be is if you pull out in front of someone without leaving enough time/distance (and even then I think the person who hit you would have to have been visible and not doing silly speeds).

Thanks for the replies folks.

I've decided not to involve insurance companies; I've sourced the parts and will fix it myself and ask the lady if she wouldn't mind contributing towards the cost of them.

What were you doing on the inside of the lorry? Not criticising or anything, just curious. Sounds like you were in the lorry's blind spot. Was the lorry overtaking you and forgot you were there or something?

You Sir are a gentleman of the highest order.

A while ago, 2002 I think, I was front vehicle in a three vehicle pile up, all caused by some stupid old bag, but ....... I missed her, the two vehicles behind got me, Police and insurance companies weren't interested in her at all.

I feel things may be a little different if , for example, you have a roadhawk, they'd find you very difficult to ignore if you had video evidence.

Can i be a good Man pleeeeease ? Some nice Lady 'whacked my back doors in' 'twice' in the same 'prang' eek last week on a local roundabout,, (bearing in mind my car is 6 weeks old and has only 1000 miles on the clock frown)

Virtually no damage & no whipcash claim, or am i a fool and should i claim for my achy neck ?

Well, I'd like to think that someone would do the same for me if the situation was reversed.

I know what insurance companies are like, they screw her come renewal time for the next 5 years and she'd have to stump up her excess.

From a more selfish point of view; several insurance companies have told me over the past couple of years that even non fault claims impact on your premiums come renewal time if you change companies.

I don't see why but it is apparently something most do now.

Admirable, but "ask if she would like to contribute"? I'd positively expect it - if she refuses, go through insurance and she'll pay a lot more ultimately. There is no reason why it should cost you a penny, you are the only blameless person in the situation!

I refused to claim whiplash when the van I was driving was hit (all of 10mph!). The passenger (in my van)claimed.. and got payed?! rolleyes
