Parking situation

Hello people,

I'm having a few issues with parking, some like minded PHers might be able to help with some advice

I rent a small unit, in a small council owned business estate (two companies, including me) and there are a couple of units at the end of the courtyard that the council use for themselves, for market stall equipement.

So, I often have a couple of cars outside, most of the time in my designated parking spaces, sometimes elsewhere, but generally parked in a pleasant arrangement and not to disturb people using the turning point (that they shouldn't be using anyway)

However, on Tuesday nights (7-9pm ish), Wednesday morning (7-8) and Wednesday night (5-6pm) the council need to get access to their units and until this point I have always been cooperative and moved any cars that might be making their life hard to do their stuff, but it's beginning to grate now. I'm always friendly, but these chaps (mainly the 'boss') are progrssively getting worse, and rather than a 'please could you move your car a few feet backwards' its a 'your car is in my way'

I then receive a phone call saying from the council offices saying I need to keep my cars within my spaces, which as I said, I usually do, as I'm now causing a disturbance to them trying to do their work....

Last week the council parked their trailer slap bang outside my door, a big car sized thing, and I had to get a vehicle cleaned and inside in a fairly short space of time, so I had to clean it slightly out of my parameter, because of their trailer!

I then get a chap telling me I'm in the way, can I move....God knows where he wanted me to go, he's in my space...I cracked on and got the car inside before he came back, so that didn't matter..

Today I get another phone call saying my cars are still in the way, which they were not, other than the two cars being in my two spaces, and finally this evening I went and spoke to the 'boss' who said my cars are getting out of hand and it's stopping them do their work, which it is not, it's just meaning they have to take a little more care when reversing. It's just stupid, my lease shows my two spaces I'm allocated but even when I park religiously within them, I'm told I'm in the way!

So what would you do? I started cooperative but it's a little stupid now, I can't exactly move my cars (there is no where else to put them anyway) and I'm not always there to shuffle things anyway...Would you stand your ground here or try think of another alternative?

Use the person who is calling you as your point of contact and get them on your side, invite them down to have a look at the parking situation. They may be able to help, better to have a friend at the council than an enemy!

I have no legal training whatsoever. This does not stop me from pontificating thus:

If you have a lease and the two parking places are specifically included in it. And if your cars are parked wholly within those parking places then I would suggest that you telephone the council and tell them that.

They may not be aware of the terms of your lease and may believe that they are just doing you a favour by "allowing" you to park in those spaces.

Personally, I would not pick an out and out fight with your council. Be firm,inform them that the lease allows you to carry out your business without let or hindrance from them and ask them to tell the "boss" to be a tad more polite in future as he will need your cooperation in the future if he wishes you to move your cars from your legally entitled parking spaces.

That'll be 500 guineas.

Are the spaces demised to your unit in the lease as part of the premises or do you only have right to use 2 allocated spaces as designated by the Council / owners of the site?

If the latter, they could give you 2 different spaces to use if this is more convenient. Parking is always a contentious issue in a shared site, if you are parking within your spaces then i don't see why they are being difficult. If you are parking elsewhere then their patience may be wearing thin as ultimately they are the owners of the site?

The last thing you want to do is p1ss them off and get some sort of parking enforcement company instructed to ticket cars / permits etc.

How clearly are your two spaces marked?

If you have two painted rectangles to park within, what's the issue?

If they are not marked, maybe the Council need to mark them for you. Or you can with their blessing / supervision.

Right then - this is my lease layout. I'm unit 5



So, whilst I'm working, I park the car lengthways across my two spaces so it's not sticking out..

Like this (and this is where they stuck their trailer!)



When it's not market day, I'll line my stuff up in the other 'spare' spaces opposite mine like so, also out the way....(I don't leave them like this over night or during market days)




Good job they don't pop down at 7am Sundays wink

So your spaces are marked on the plans but not physically on the tarmac?

How can anyone "police" that?

Get a can of spray paint and a straight edge.

No physical markings on the floor no, I have suggested they do it, but then I will park religiously there all the time rather than trying to be flexible when needed, so they really will shoot themselves in the foot IMO

Best of all, the chap in unit 6 has new drawings as he's just signed up, he's got two spaces which fall slap bang in front of their door, and he's got real 'sit down' clients that I can't see being best pleased having to move their cars...

You only have two parking spaces but you utilise more, looking at the deeds you have no access to those opposite, obviously they could make life difficult there.

Way I see it you have two choices, play it exactly to the rules and stick to only your bays, in which case get them marked (and some recording CCTV in case of hits) or keep using other peoples bays but expect a flexible approach yours.
