Hi, i would very much wellcome views, comment and advice here. We ordered a new Kia Niro over 6 weeks ago, today (25th April) the dealer phoned up and told me Kia have changed the spec and I need to cancel the original order and agree a new order. The dealer stated that its all down to Kia and that there might be a change in price!!

I have a feeling that I am getting bent over by the dealer.

I would assume that I have a few options, but what do you guys think?

Do I have any legal come back???

What power (control) do I have??

It would depend on if you have signed the deal and paid for the car yet?

Hi, we signed the order and paid £1000 deposit on the 11th March.

Can't see the problem, as you would probably be getting a better spec with a new model year?

Also, i am sure if you read the terms, they are within their rights.

This does happen, it has happened to me as a supplying dealer; car gets ordered, ordering is closed for some reason or other (it is a common occurrence), then a spec change/update/new model/facelift is announced so the original car cannot be ordered so it either has to be the newer revised model with a different pricing and spec structure and likely different financing options, either the dealer will suck up the extra costs or sometimes the manufacturer to keep a deal or this cannot be done or the revised spec isn't liked by the customer so the order is cancelled and deposits are refunded.

Why does there always have to be some conspiracy?!

If the above is the reason, what legal come back would you have; they have to build and supply what you ordered?

Thanks to you both, the issue I have is that the order was placed over six weeks ago, why the delay in stating I cannot have the vehicle I ordered. I know how dealer commission works on new release vehicles. My bet is that they held the order back. I accept that my only options are to walk or accept the change. I wil not accept an increase in price, I hope they suck up the increase.

I've had an order put on the system knowing that that particular engine/spec/model is due an update in the near future but have been told that all orders added, up to a specific date will be "fulfilled centrally" (basically the manufacturer will match the order up with a current model build slot), and then 8 weeks (and sometimes longer) later I've been told "sorry no can do, it'll have to be the new/revised/face-lift version as all build slots have been allocated, oh and it'll be 3 months from now before you get it!"

It sounds as though you've just ordered a particular model at the wrong time; as simple as that.
