This looks like old news; I think the case should have gone to court already, but I can’t find any recent links via Google.

Let me get this straight. They charged him for DWDCAA, even though she walked out in front of him (where the car has priority), during the night (so it could be unlikely that the driver could see her anyway) in an un-illuminated area (faulty and obscured streetlamps, resulting with a “pool of darkness”), and she did not even see his headlamps approaching? At least he wasn’t speeding.

I think you'll find that pedestrians have right of way over everone, followed by bicycles, motorcycles, buses, trucks and finally cars.

Why is it always the motorist's fault? The following is some of what the Highway Code has to say about pedestrians crossing the road:

7: The Green Cross Code. The advice given below on crossing the road is for all pedestrians. ...

a. First find a safe place to cross. ... choose a place where you can see clearly in all directions. ... Move to a space where drivers can see you clearly.

c. Look all around for traffic ... Listen as well, because you can sometimes hear traffic before you see it.

d. If traffic is coming, let it pass. Look all around again and listen. Do not cross until there is a safe gap in the traffic and you are certain that there is plenty of time.

e. When it is safe, go straight across the road - do not run. Keep looking and listening for traffic while you cross, in case there is any traffic you did not see, or in case other traffic appears suddenly.


Tragic though this acident is, if the victim had followed the Green Cross Code, she might still be alive and the poor motorists might not have had the trauma of killing her and then having to appear in court.

Green cross code is fool proof if you follow it accurately.

Thats assuming people drive following the highway code (ie, lights on in the dark, not driving down pavements etc etc)
