Got this 'tip' sent to me today. Don't think I'll be trying it

The majority of police officers don’t know that PACE doesn’t apply to summary offences so most Constabularies Traffic Officers Caution drivers for speeding. However, not many patrol cars actually carry a copy of PACE so the first thing they will probably have to do is radio to the station and ask someone to bring them a copy!!

From vague/hazy memory ...

A copy of PACE is provided for you when you are taken into custody, not at time of arrest. There is always a copy available for detainees in custody, and you are usually asked if you wish to have a copy of it.

Secondly, PACE applies to arrest, irrelevant of the type of offence.

It is impractical, and I believe legally so, to provide copies of PACE at time of arrest, as you would be taken into custody immediately for your own/officers safety.

But don't quote me on that ver batim.

Isnt this just another sketchy sort of defence that may work in the vast minority of cases if at all that people are going to try, its then going to p!ss the boys in blue off even more and speeding fines are going to become even more prevalent?

Ted pass this tip back. If someone dosn't understand the caution we are supposed to try and explain it in everyday words/plain English, having done that,I would simply write down you reply on the back of the ticket, ask them to sign it, give them the ticket. As already pointed out your right to consult the PACE codes of practice usually applies to persons in detention, and even then it does not permit the delaying of certain procedures ie drink/drive. You may dislike smart arse cops, but we are human, do you not think that we may also dislike smart arse persons. Just try dealing with us in a polite manner, you will generally get a like reply

And let's face it, if the stories about them scrapping the Traffic group in Nottingham are anything to go by, your chances of actually being pulled over by plod are decreasing by the day....

I'd go along with that Nick so would suggest as follows:

If you would like to "buy yourself some time", in order to have a think etc., you should stop your car immediately in the middle of the road and call the civilian desk clerk on your mobile phone (hands free of course)and say the words precisely so why not keep them in your car.

Two things will happen. They will treat you as a raving lunatic and they will have to send out a copy of PACE, which is a very thick and complex document (by TNT as they will have scrapped all patrol cars). You can sit in the back of the couriers van and read it for as long as you like and they can’t continue until you have finished or the delivery driver has kicked the shit out of you!

The majority of GATSO's don’t know that PACE doesn’t apply to grey boxes so most just take a picture. However, not many camera sites actually have a copy of PACE so the first thing the civilian desk clerk will do is call out the duty Social worker and have you commited to an institution for the rest of your natural!!
