Just a quick one, Parked up outside a hotel I was staying at last night, the restrictions were Max stay 1 hour between 8:30AM - 6PM, with a permit, or overnight stay, also with a permit.

So i asked in the hotel and got given a permit (time disky thingy..) and set it to 6:15, which was the time I got there. I was out of the hotel at 9:25AM, which was my overnight stay + 1 hour. There was also a penalty charge notice glued to my screen, issued at 9:15AM.

I don't mind paying it if I'm in the wrong, but thought I would ask the power of PH before i click submit payment.


I have a photo of the sign if that helps.

Are you sure the signs definitely read 0830 to 1800?

If they did then the ticket should not have been issued until 0931 and it has been wrongly issued.

Here is all the sign.

Disc zone.
Mon - sat
8.30 am - 6 pm
1 hour.

No return within 1 hour
Permit holders exempt. [C]

I didn't have a C permit, just one of the parking cards with a spin disc for the time.

Had you gone out at 8:30 and reset the disc you'd have been fine. So far as the ticket issuer was concerned you'd been there 15 hours. I'd read the sign as saying that between 8:30 and 18:00 you can stay 1 hour from when your disc is set.

Of course, the sensible option would have been to speak to the hotel reception about the ticket rather than on here as it probably happens all the time.

Does the ticket say "Penalty Charge Notice" and look like it's council issued or "Parking Charge Notice" and look company issued? If the latter bin it anyway.

It appears that you weren't given a permit, you were given a disc which was only applicable from 8.30 to 18.00 so you could have been ticketed at any time.

But surely there are no restrictions outside those times so anyone can park there, permit/disk or not. I read it similar to a free for an hour parking bay. You dont have to park up exactly on the start of the enforcement time to get your free hour, the clock starts counting from when the hour comes into force no matter how long the vehicle has been there before.

I also read it as this, but the fact I stupidly set the disc, and didnt reset it at 8.30 creates a slight grey area for me.

Looks like I'll swallow it, only £25, paid £20 in total for thursday evening and friday morning in a local P&D car park, so an extra £5 to not have to lug my bags about for ten mins can be considered a bargin.

The fine was issued by a council.

Would be interesting to see if they can actually enforce the disk thing seeing as most people won't know what they are!

There's no harm trying to contest it.

Indeed it was! smile Have you had similar, or are you stalking me?

I shall probably pay it on monday, and appeal it. Dont want to lose out of the 50% reduction if they decide it was lawfully issued.

errrrr since when has a Parking time disc been a residents permit????

One could try an appeal but on what stated I would consider going for the reduced Penalty.

Not sure you can pay and then appeal, other than to their better nature. Depending on how clear the instrutions for setting the disc are, I'd be inclined to appeal properly. Pepipoo will probably be able to advise further.

From what has been written, the disc would entitle the OP to one hours parking during the restricted hours of 08:30-18:00, surely? The residents permit is an exemption to the restriction, and allows parking for longer periods between 08:30-18:00.

Yes you're right , my mistake. Oh and I think the OP should appeal as it would be very pedantic to insist the disc should have been set to 8.30.

We've got disc zones everywhere here and if it carries the same rules then it would be that you have to set the disc at the time of arrival, even if you are in the overnight hours. You get one hour from the time of arrival unless overnight which means you need to leave at the start of the time zone if your hour runs out before.

I haven't paid it as yet, I will call their offices tomorrow and have a word, and if they say its legit I'll pay.
