What can I do about my accountant who is causing me major greif with HMRC,Companies house and the bank, long story short:

In Sept 2008 companies house informed me that the 2007/2008 accounts and anual return had not been filed, eventually filed Sept 2010. 2009 anual return filed but late and I am still waiting for 2008/2009 accounts.

Companies house have circa £4k late filing penalties against me. Since the letter from Companies Hose in 2008 I have chased this man over the phone, visits to his office and home and I have been given excuse after excuse, I know he is trying to cover his arse for what reson I do not know.

It seems pointless taking the paperwork off him to hand to another accountant untill the 2008/2009 accounts are done, I doubt he would release them without payment.


What are your thoughts on the filing penalties and his fee's, mine are that it is
his incompetance and he should pay the penalty fees and then aggree a figure for his work and leave.

Ultimately the responsiblity for filing accounts, annual returns etc is that of the Directors.

To have any recourse to the accountant for the late filing penalties you are going to need to dig out a copy of your engagement letter with him and check that it says he is to do these things for you.

What professional body does he belong to?

My first course of action would be to speak to them on a non names basis, find out what their complaints process is and what action they take. Armed with this you can meet the accountant, set out clearly what you wnat doing and by when and explain that if it is not done you will raise a complaint with his institute

If i was you matey, present yourself at his place of work. Demand your stuff back, if he refuses then inform him he only has a right of lien over work that has been DONE.

Take to another accountant, pref one you've been recommended off someone you know well. Job Done. There are plenty of good, honest and fairly priced accountants out there, you dont need to be with someone that doesn't want to do work for you.

We had a similar problem to you. Our previous accountant also registered our company as DORMANT quite a few years ago when we were just starting up.

We did the only thing we could do. Found ourselves the most experienced, trusted Chartered Accountant in the area - he sorted everything. From advice, to writing letters to the other accountant and getting our books back, and to HMRC.

Used him for 5 years now, and never had any issues.

Get top professional help.
