Paid deposit on private sale now seller wants 25% more askin

Saw a MB CLK63 Cab at £15,500 online
Its in London done 101k miles so I asked if a MB health check could be done if so I will pay £350 more and the balance on collection.
All done and emails with pictures etc and an email this morning stating the discs and pads needed doing circa £1400 - no problem I expected it still having it no haggling.
Email tonight saying very apologetically that traders had called offering full price saying its very cheap, he looked a few up that had been sold and now wants £20,500.
He has offered to refund my £150
What would you do and what are my rights (if any) transfer was requested as a deposit on the sale of the car and was none refundable as far as I was concerned and paid to his bank.

Not 25% its gone from £15,990 and a haggle to £25k - more than the decent no work required ones that have sold before. Its a certain "type" of person I guess who has no clue what they are driving or its value until told. He should be happy in a Datsun Bluebird!
Did you think the car was under priced when you offered to buy it?John Laverick said:
I like to think I have good morals ..... but if I agreed £15k for a private sale (and had taken a deposit) then received another dealer offer of £20k I would find it VERY hard to not back out of the originally agreed sale.
£5k is £5k after all and I would suggest most people on this forum would do the same.
He hasnt got an offer he had a friendly trader advise if was underpriced without knowing it needs paint, suspension and brakes.£5k is £5k after all and I would suggest most people on this forum would do the same.

I'm just quoting what you said in your original post ... he has an offer.Either way ... I personally couldn't stomach turning down a potential extra £5k and honestly hand on heart could you if you were in the same situation?
With regard to the selling price dilemma I would have priced the car to market - I would have had the work done and sold it at £19,900 ono

Can you post the add now seeing as you don't want the car.
I noticed this one http://www.ebay.co.uk/itm/Amg-Mercedes-Benz-clk-63...which seems a better deal to be honest
