Story is as follows.

I have auto pay on my dart charge account. On the 13/05/17 I made a dart charge crossing. My account went 67p into arrears. I topped up 1 day too late.

I had moved and my car was registered to the incorrect address (this has now been rectified). As such, 3 notices were sent to my old address to pay a fine.

My details have been passed to Marstons high court enforcement and the total repayable is £190.50.

The details of address on my dartford charge account are correct.

Letter below. I have received no correspondence from a court, this is my first letter and I have made full payment. But I contacted the dartford crossing people and they have advised me to fill out 2 forms. TE7 and a TE9, both linked below. These look like court papers. I've checked my credit report and I don't have any CCJ's listed but I don't know how long such a thing would take to appear.

Thank you in advance.

Fill in the forms. There is a court process on foot, but if you satisfy the court that you did not receive the initial penalty notice, you will have a chance to pay the penalty and bring the matter to a close.
I have paid the £190.50

The highways agency said that the debt was passed to Marstons. Unsure if they have gone through the court.

I should add this letter isn't from a court etc. Just from Marstons.

Happy to fill out forms, highways agency fella said that I shouldn’t worry but it is easy enough for him to say.

Just read this...

it is a Dart Charge, then it probably won't be a CCJ, but a Notice of Enforcement that has gone through Northampton Traffic Enforcement Centre. It wont be on your credit file, but it will be enough for Marstons/JBW?whyte & Co etc to levy on - ie, taking your car or goods.

You will need to complete a TE3 and/or TE7 form to ask the court to review the decision, and explain why you are repsonding late - if you have moved house and they are still using your old address, this is normally a valid reason for having it reversed. It doesn't cancel the ticket, just reset the process. Fill it out, take it to your local court for countersigning, and email it to tec.bulkcentre@hmcts.gsi.gov.uk

If it is not Dart and for say a double yellow or box junction, you may need a PE3 & PE7, similar process, different forms.

You can download the forms form here - https://hmctsformfinder.justice.gov.uk/HMCTS/FormF...

No, you haven't.
Phew, thank you sir. I struggled to read.

I'm assuming if I hadn't paid, then it would have done. So now I need to fill out the forms to try and reclaim the fees.

If OP had an account, why not an auto-top up? I thought that was necessary. Also with an account you have a monthly statement.
I just never set up auto top up. I was a day late paying the 67p balance. Fair cop but annoying.

No one to blame here but the OP. The Dartford crossing system is as good as it gets. By his own admission the OP screwed up with his admin
This.

He didn't fail to pay 67p, he failed to pay the entire £2.50 fee, because there wasn't enough in his online account, and they don't give you an "overdraft".
The penalty for that would have been £35 if he'd paid it within 14 days - but it's now six months.

It's all very well documented...

I'm not disputing the charge, I'm just checking I haven't got a CCJ hehe

Blimey you lot are an angry bunch.

Its obviously set up to maximise profits. Its human nature to put of doing things we don't enjoy until the last minute, paying bills is one of them. I would imagine everyone who goes through has the conscious decision to pay it "in a minute" but by the time you have remembered its too late and you have a fine.

I sometimes lend tools out on site and literally nobody brings them back, its just too easy not to, I have to ask for them every time. However if I took a £10 deposit off people when they borrowed them they would bring them back every time. IT should have a toll booth or two for cash payments, the M6 Toll seems to do ok.
Not quite, I just changed my address after I moved on the V5. I have opportunity to appeal and I will be doing so.

Although I just received a letter dated 20th as a reminder to pay even though I paid on the 18th. I'm guessing that they don't bank on a Saturday and as such would have only banked the payment on the Monday.

I have emailed them to confirm this is the case.
