I parked at the local chinese few months back in the wifes car, only when we left and saw the ticket on the window did I look and try and find any signs to say it was private. There was 1, hidden by a large merc sprinter and another sign with a light above it which the bulb was out. I took photos to prove this. Had 1 letter off the parking company for an invoice of £100. I wrote back saying the signage was very poor and 2 people have access to the vehicle so was unsure who was driving.
Fast forward couple of months later and now my partner has a court date in November. The parking companies solicitors have written to me this week to say they are using the fast track small claims process and that the parking company wont be attending. As a side note they sent me all the proof of my wifes vehicle parked etc (their own pictures show the light above the sign is out). In this evidence letter they have included someone else's details, by accident I guess. It lists someone else's name address and car.

Ive had a couple of these over the years and always ignored them. If it goes to court and we loose, is there a limit to what costs I have to pay of theirs?

yes we used the chinese but it was not their car park, it was a residents for old peoples flats.
The company was europarking.
I sent a letter back to them but it was not an appeal etc.
they have sent me several invoices and threats of court, the amount has gone up and up then down and down trying to get me to pay something which I refused.
They are not attending the court but I believe their solicitor is.

Who was the chap that was on here or possibly another thread that gave good advice, I think his name might have been steve?

just about to send defence over to the court. Just noticed on the site plan the claimant has given. There are 2 signs on the wall which are missing which they state are there. These would be right in front of my car . This is evidenced in their pictures as there is no signage near my car at all. also another sign is not present on the back wall. The van that is blocking the sign on the front as you come in is there on the google map picture which they have provided from Feb this year.

Indeed. Although it was very extenuating circumstances. But hey ho, the problem I had at home was far more important than a court date or any fine etc I will incur. Just annoying as I would of liked nothing more than to attend, but so is life.

Update: I had a letter saying I had lost etc. Then the next day another letter advising that the court had only read my evidence 4 days after the hearing so on that basis would re arrange it for the 17th December. A stroke of very good luck that the court hadnt read my evidence!

^ We had a letter from the hospital to come in as soon as possible re birth of our child. I have scanned it in and sent it as evidence.

Update: this case was won and I thought this was put to bed back in April. Today I received this, I have never had any other correspondence since before the court. Have phoned up and left message, awaiting a call back.

We atteneded court March 2020 and won. I called Gladstones today and they said the error was on their part. No ccj has been applied for. I used a credit agency checker today to confirm this.
