Currently, some nationalities on track days are covered by their normal road policies.

So - some German TDO's expressly require participants to be in street legal, insured vehicles so that any on track altercations can be dealt with by insurers in the same way as any normal road traffic accident.
I've had discussions with some German TDO's that allow British participants in street legal, insured cars to participate on their events but make it clear in their disclaimers to all participants that any claims between drivers MAY be limited to third party claims only (say if there was a coming together of a British and German car for example)

Here in Britain we all know our road policies generally don't include track days. And anyone interested will have an understanding of the potential problems of touristenfahrten and ultimate liabilities.

I can't speak for other British TDO's but I know how I do it. As a condition of entry each participant, no matter which country they're from, waives their right to initiate an insurance claim against any other participant. I felt it was the tidiest way to do it, and it's been tested, successfully, a couple of times over the years.

I did go a step further a few years ago and split my events into Super 'Street Legal' and 'Pro-Track' formats but that wasn't for insurance reasons - more to manage the performance/speed differences when mixing road and race cars on track.

Of course, like all things in life, ultimately you can never fully escape the possibility that someone determined will pursue you via a civil action if things go properly south.

But I've always tried to set out clearly what's expected of participants in advance and so far that's stood everyone well.

I know the specific incident Phil and Jay are referring to in the video.
Not a pleasant situation to find oneself in - at all.
