The guy has pulled over as best he can, and presumably done what he's had to do while trying to sort out what to do with it.
Luckily the police took the car to the pound out of the way

Aren't you allowed to abandon things?Say you have a wedding to be best man at, or maybe an appointment which isn't going to move.
Isnt that why hard shoulders are useful. You can 'abandon' the car there - get a lift to get some petrol and youre on your way

Even so, new ones often have a side strip for parking up in.
Motorways have higher speeds and if its safer there's a move to go to 80mph limit which will help differentiate them.
If a smart motorway was as smart as is alleged there'd be no need for the guy to pull over tight, the cones or the HATO,
The lane would automatically close as soon as it detects someone's parked up in it.
Never mind - no harm done

I'm all for expanding motorways and can see why they've done it this way (lack of funds to do it properly), but it's just another Grenfell tower type situation in waiting.
There should be less barriers, or they should have been moved further away to allow a 'soft shoulder' for emergency break downs.
They could also make the early warning messages actually work properly, I have never, ever, ever driven through a set of warning signs to find 'Debris on the carriageway', 'People on the carriageway' or rarely any good reason to be doing 50 when it was supposed to be 70. They just seem to put them on and leave them on for 6hrs after the event creating a 'Boy who cried wolf' situation. To me it just means don't slow down at all, just be extra vigilant.

If by the third, still nothing, theyve been left on by mistake, as you were.
