A dispute over the legality of speed cameras, that could have seen the devices outlawed, has been thrown out of court in Scotland.
The Court of Appeal in Edinburgh rejected the claim by Robbie the Pict on that grounds that it was an unacceptable 'misuse' of the legal system by a known complainant.
Robbie the Pict's case centred around the use of laser speed detection devices, similar to those used to catch the campaigner on the A74(M) in Dumfriesshire. Robbie, an Isle of Skye community lawyer who changed his name from Brian Roberston in 1984, argued that each different model of camera had to be approved by statutory instrument in order for a prosecution to be affective. He also told the court that Scottish law made no provision for a legal motorway speed limit.
The court ruled that the 'ill-founded technical arguments' within Robbie's case ensured that his appeal failed, preventing the likely need to return more than £600m in fines accumulated through the use of 'illegal' speed cameras.
