Will I get fined?
Discussion
I was driving the SLS at 38 in a 40 on a two lane road when a police van came behind me with blues and twos full on. I could not pull over as there was a car to my right so I accelerated to get in front of home and let the BiB past when I was flashed from the front. I hope the van is in the shot as I don't think I deserve to get done when I was just getting out of his way, what do you guys recommend I do?
I always thought that when the emergency services were trying to get past you have to make every effort to allow them through. I did this the only way I could by accelerating so O could get into the inside lane and guess driving an SLS a small touch of the throttle from 38 it could be that my speed rose considerably over the short distance. I have decided that I will contest this if I receive a penalty as I would believe the police vehicle would be in the shot.

OP was the camera a Gatso, Truvelo or Redspeed camera? Google pics of them if you don't know what I am talking about.
Only Truvelo takes photos of the front of the vehicle. Gatsos can sometimes go off and take a photo of the front of a vehicle, but prosecutions do not follow if this happens.
In addition, if it was a Gatso, was there one or two flashes?
It was a Truvelo and it flashed only once.Only Truvelo takes photos of the front of the vehicle. Gatsos can sometimes go off and take a photo of the front of a vehicle, but prosecutions do not follow if this happens.

To all, thank you to all of you genuine Ph members who have understood my thread and provided some useful guidance about the issue. To all of you other W**kers I would like you to know that I have worked hard all my life to be able to afford an SLS and PORSHE and Q7 and JCW and HYABUSA so could not care if you question my credibility on this site your all just a bunch of sad B**tards.
Mr SLS here to provide an update. Received the nip this morning and after discussing the matter with the Police using number providesd they have advised that I complete the form and put a letter explaining the circumstances . They will look at the photograph and check their records and she advised that it was normal that in such circumstances that they will not prosecute. Note the recorded speed was 46 mph. Watch this space.
Update, I just received notice that i will be prosecuted after dismissing the mitigating circumstances I presented by letter. I feel quite pi**ed off at this and would like to know if any of you lot can advise me if I can ask for the photograph before I decide whether or not to take this further. Options are take the fine, go on speed awareness course or go to court.
Sent an email to the police yesterday advising that I have accepted the speed awareness course and that I would have preferred to attend a court hearing but due to financial burden with me working in China this was not feasible. I also requested the address of the police complaints department as I was not happy that they dismissed the mitigating circumstances without any explanation. They replied with an apology and said after further review of the footage that as I was in the inside lane and police emergency services in the outside lane I had no reason to be speeding ignoring the fact that I was originally in the outside lane and had to increase my speed. I told them this and have not yet received a response so hopefully I will get my prosecution upturned.

Have a read of my post earlier in this thread. It'll give you a different perspective on what's a waste of time fighting. I fought out of principle, and I won. There's no reason why the OP couldn't.
I have already accepted the speeding awareness course as I am unfortunately not in the position to carry out a court attendance for two reasons, first being the cost implications due to my current assignment in China and secondly I would have trouble keeping my visa should I have any criminal record (Even a motoring offence ). I do however intend to at least try and have this issue elevated in the hope that the general public understand the consequence of breaking the law to support emergency services. You were right to go to court and I am glad you won, this gives me some hope that the police will come to the right decision in my case. They have not responded to my last email so maybe they are reconsidering their decision after not reading the mitigating circumstances correctly.Got a result yesterday with the police Chief Officer cancelling my speeding offence after carrying out another review if the mitigating circumstances. I can now drive The SLS feeling vindicated. It just goes to show that even if you accept the penalty as many of us are often forced to do, you can still continue to try and get justice without the need for legal representation. I only wish that the original submission of the NIP with the mitigating circumstances had been read properly but then again I could have had the lanes mixed up as I did in the start of this thread lol. Thank you all for the advice and my trust in the BIB has now been restored, but I will be fitting a dash camera when I get home to The SLS.

great. Next time your out in the SLS do at least double the speed limit to celebrate and get your own back
Hahahaha, like that idea, I will take my frustration out in may when I get home after 8 long weeks in China except it will be in Germany on my yearly trip in the SLS Gassing Station | Speed, Plod & the Law | Top of Page | What's New | My Stuff
