Myself and the missus would be forever grateful if any law minded folk could take time out to read and give some advice on some issues she is experiencing in work.

Today she heard some news which will all be explained in the excerpt from her email below. She is still trying to get to the bottom of the problem but as a great and caring boyfriend I thought I would try tap into the vast pool of knowledge, opinions and wisecracks that can only found on pistonheads - and pass off all intelligent responses (if any) off as my own. hehejester

She's already onto the Citizens advice bureau, researching the tinternet etc but to no avail.

Any help to ease her worrying would be much appreciated

When the company we were working for (Company A) ran into financial difficulties another company (Company B) approached them. Company B bought the ‘assets’ and the ‘goodwill’ of the company on April 9th 2009 and Company A went into ‘administration’. Eleven employees began working for Company B; these employees had not been paid for 2 weeks and therefore were sent the appropriate forms from the administrators to claim their wages off the Government (Department of Redundancy). We have been told today be the department that our wages claims have been rejected because the date of administration was the 28/04/09 (news to us) and that it was a solvent transfer. Apparently, a letter will be issued telling us to start an Employment Tribunal to claim our wages because agreements have already been made prior to the undertaking and we should ask the Directors. How can we ask the Directors or start an Employment Tribunal when the company is in administration. This is a lot of money owed to us. No one seems to be able to help us, I would be grateful for any advice on the situation.

I think it refers to the new company that has taken on the business, along TUPE lines...Although it's more likely that the Government department is not wanting the 'buck' to stop there.
