Hi

Buying a house that is on an unadopted road.

Local Authority Search and Title Deeds confirm that the house is on an unadopted road.

House was built 20 years ago on an estate.
The section of unadopted road is block paved and is a cul-de-sac.
Adopted roads run everywhere throughout the estate but are tarmac'd.

The unadopted road is about 30m x 30m.

Our sellers are saying they are not on an unadopted road as thy can access their driveway from an adopted road (which is arguably true). But, that does not change the local search/title deeds.

The unadopted road is in good condition.
We do not know of any management of the unadopted road, nor do we want to ask - as then we'll be signed up - should a management group exist.

We are concerned about:
- repair costs (particularly if the council repair the road then re-charge the residents)
- public liability for injury.

I can find (very expensive) insurance for public liability.

I cannot find anyone willing to provide insurance for the maintenance.

A couple of questions

How many other houses on the road?

If you don't own the road why do you think you will require insurance?

I live on an unadopted road. It's never been a problem for us for over a decade.

Near where I live is a private road for a row of nice detached houses. It used to be a rat run for school drop off . The residents had it blocked, stopping the rat run. I knew one rseident and the cost as split equally between all properties. I think they had an agreement to that effect. No details though.
OP...get checks on ownership of the road and who bears costs fot maintenance, especially if other properties are on the road. Is the road private or unadopted? Ghere must be details somewhere, ( deeds planning for build etc).
By " insurance" do you mean indemnity cover?

This sounds pretty much identical to where I live. Four houses, block paved area in front. Our plans show that we each own a quarter-ish of that area. I've been here ten years and we broadly just keep it clean/tidy/swept between us. Not needed anything in that time but the general consensus is when/if the time comes, it gets split four ways. Don't have special insurance for it, not paid anything out in the time I've been here.
