Was in a small-ish car accident yesterday. No major damage to each car but was enough to send me forwards in the chair. Police were called to the scene so I didn’t have a choice but to also report it to my insurer. When I called to report they asked if there was any injury and I said no.

Woken up this morning in lots of pain on my right hand, wrist and forearm. It was bad enough for me to go to A&E where I was told I have Ulnar Nerve damage.

Been advised not to use it unless absolutely necessary which is very annoying because it’s my dominant hand.

Obviously I’ve had the insurer on the phone asking if I’m ok and if I want to make a claim. The car isn’t too bad, so I decided I’d get the paint stuff done myself but obviously an injury is a bit confusing.

Has anyone been in this scenario and how did you weigh up wether you would claim? In fact, what do you even claim for?

The big thing for me is I can’t ride a motorbike for the next 2 weeks at the very least which means I’ll have to commute by train.

I don’t really know. Just hoping to get opinions and advice on what to do next.

Tell them the honest truth, your injured and they will do what they can. Simple

I'd be taking him to the cleaners. Really boils my urine when people mess around on their phone when driving.

If he has admitted it it should be an easy claim for you.

It's a shame that because of so many people scamming, genuinely injured people are worried about claiming.

Tell your insurer about what happened when you woke up today. Let them handle it. You pay them for that.

You actually don’t pay your insurer to deal with your own claim for personal injury or any other uninsured losses. Either go to a no win no fee solicitor or one appointed by your legal expenses insurer if you have one.

Your insurer only want to know about injuries so that they can sell your claim into a third parry claims management company.

I paid extra for legal expenses cover when taking out my policy so that’s all I need right?

Some injuries don't show up for a day or two.

The same happens if you overdo the gardening today you might not fully feel the aches and pains until tomorrow.

Quite possibly your insurer is half expecting injuries not apparent yesterday to show themselves today.

The insurance will pay out accordingly.

I'm confused, one minute you are saying that there is only minor paint damage that you'll sort yourself and you wouldn't have even reported it to your insurance if the police hadn't turned up. But then you are also saying it threw you forward in the chair and you have sustained an injury. Which is it???

I'm not ordinarily a supporter of the "claim whatever you can" attitude as it just pushes up insurance premiums and keeps ambulance chasers in work.

However, if the driver at fault was on their phone they and everyone else that does the same needs to be taught a lesson. If you have Legal Cover as part of your policy I recommend using it to claim for the physical injury and impacts such as inability to ride your bike.

Unless you’re the District Judge that will be hearing the claim if it goes that far, it’s none of your business is it.

Both, clearly.

Even very slow impacts give a hell of a jolt. Bumpers are designed to take the impact and may show little damage.

Both.

There is only minor paint damage to the car as it was a relatively low speed impact. I'd estimate he went into my stationary car at 4 or 5 MPH - not enough to do any major damage to a vehicle but enough to jolt/shock somebody forward in a chair.

It's being discussed because I asked for advice. I've only ever heard of people claiming for 'COMPENSAYSHUN' so wasn't sure how it all worked if you had a genuine concern.

My biggest concern right now is how do I get to work if I can't ride a motorbike and how do I get a GP appointment without taking a day off work - I wondered if going through my insurance would help me with these things. Not so much, wrist hurts give me money.

He was on his phone. Admitted to me he was looking at the map instead of where he was going. Really wish I had recorded the interaction now as I doubt he'll admit it to his insurers.

You will need to take time off to see a GP.

You will need to arrange alternate transport (train) if you can’t ride a bike.

These are called uninsured losses, and will form part of your claim against the third party.

Might be worth having your car inspected too. Like your wrist, damage can be hidden.

Yep. Planning to do this. Just awkward trying to arrange it without taking time off work.
