Can anyone recommend someone to advise financially regarding a potential divorce for someone that bought their house when single with their inheritance & their partner moved in with them?

House wasn’t and still isn’t in joint names. Their name is the only name connected to it on land registry.

Asking for a friend, not for me or for anyone local to me either before anyone jumps to conclusions…

I should mention, this is a same sex 2nd marriage for them both

Married 10 years, no joint kids, there are adult ones from previous marriages (she was widowed young)

Her name is the only one of the land registry, there is no mortgage. House was bought outright by her for cash prior to marriage.

All help is appreciated

Wife is on £40k. My friend is not earning due to disability.

While we wait for an expert to arrive, from my understanding it would depend on if there are any kids involved, how many years they live together as a couple and if they are actually married?

How long have they been together? Is there a mortgage on the property?

Thanks guys

Married 10 years, no joint kids, there are adult ones from previous marriages (she was widowed young)

As her name is the only one of the land registry, I’m assuming no mortgage.

There is no reason to assume there is no mortgage because there is only one name on the land registry.....

Speaking from a very similar situation (house was mine, together for 8 years). It will be included with all marital assets for negotiations. The divorce laws in this country need rethinking for situations like this.

50/50 split I hope. As would be the case in a man woman marriage.

Is it not the case that assets before a marriage are not included in any divorce?

If the asset has subsequently increased in value since the marriage, then the other half is entitled to 50% of the increase in value, not the initial value at the time of marriage?

ETA.... Load of tosh..... very complicated bit of agro this!!

Would depend on the needs of each party and the length of the marriage. I would imagine at 10 years the negotiation starts from 50/50.

Not sure why anyone would want to get married, especially with uneven assets.

thumbup she has confirmed there was no mortgage, she bought it in cash before the relationship.

If you lived in a £1,000,000 house that you owned outright, and then later got married to someone with nothing, I wonder whether you would still be hoping that you spouse was entitled to a half a million quid jackpot from you should he/she decide there's a better offer on the horizon and wants out of the marriage? scratchchin

Because you don’t go into a marriage expecting to get divorced!

Exactly!!

Especially when they work & you cannot anymore due to a disability.
The income differentials will help....plus you haven't mentioned if the other party has any assets.
