A car sold as Approved Used by a BMW main agent should meet the definition of 'road legal'. This clearly is not as it failed the MOT based on the fact its had the wrong rear light clusters fitted.

In my eyes the dealer should carry out the remedial work free of charge, i.e. fit the reflectors in the bumper that are designed to accompany those light clusters.
Strictly speaking what you've just said isn't accurate though, not according to what has been said in this thread at any rate.

The dealer is no more responsible than all the MoT testers that have also missed the missing reflectors.

At most all the dealer would be liable for would be the cost of the reflectors, there is no MoT re-test fee, so you couldn't claim that back. But how much would it cost an individual via a court to get a payout of under £10?

It does have reflectors in the tail lamps but just white not red, so it isn't invisible in gloom but yeah texter's wont see it hehehehe
From memory I think you'll find if you park another car with its headlamps on behind the MINI you'll find the reflectors in the lamps glow red however in daylight they dont.

Back in 2001 when they went on sale the clear lamps were legal in Germany where the MINI Accessories are designed. MINI UK didn't even realise there was a problem for about 2 years, once they were aware of the issue they would only sell the lamps to a dealer with the offical reflector kit and they withdrew them from the UK market shortly afterwards.

Fitting the reflectors added about £200.00 to the supply and fit price of the lamp kit as the bumper had to be taken off for the slots to be cut out. As a result most buyers either didn't bother having them fitted or the Salesman / Woman simply didn't tell them as they wanted the sale of the lamps.

From my experience when MINI Dealers first did MOT's on the cars at 3 years old they tended to either turn a blind eye to avoid conflict with the customer or fit stick on ones costing a few quid.
