Focus RS Broke down - fuming with Ford!

It's my understanding although I may be wrong that the issue is a small percentage of vehicles were fitted with the wrong HG (from the Mustang interestingly) the HGs are not different enough to the naked eye to differentiate and therefore; somehow Mustang HGs made their way into some RS engines. This blocks off a waterway from what I hear which boils fluid and causes the failure (long story short).
Now that being the case I can somewhat see your point as IF this is the case with your particular car then it would have likely failed anyway however the problem is that your issue has been compounded/exacerbated/muddied by the modifications of unknown origin. It's an interesting and extremely frustrating situation you're in**.

Oh Jeff, why won't you just post the damn picture of the car and stop arguing with the Internet. Wouldn't it be great it you could prove everyone wrong about you? So simple, but you won't do it, will you?
Wouldn't it just be marvelous it turns out here is a real Focus RS in this tale and that the head gasket was at fault due to Ford using the Mustang Head gasket instead of the Focus one (apparently the cause of the problem)?
Because that is a known issue it *may* even be accepted by Ford as their liability even if the car is modded as it is clearly the wrong part fitted.

The car has been modded by a third party. Therefore you need to prove the mods had nothing to do with it. If, for example the sat nav failed, then you can show the mods to the engine are not anything to do with it and Ford (in theory) would replace it.
However a headgasket, despite being a known fault, could still have been caused by a bad map or whatever other mods it has. If the engine temps are getting too hot for the cooling system to handle, then the headgasket can blow. Ford have their getout clause and have no obligation to pay. This is not Ford's own warranty that specifies this, this is the same for every car warranty there is.
For example, lets say a model of iPhone had a known fault where the water-proofing was failing and water got into the phone and damaged it, but Apple claimed it was water-proof. If the phone was completely original, they would replace the phone. However, if you had the screen replaced with a 3rd party item Apple would (rightly) say that the phone has been altered by someone else and they cannot honour the warranty.
Ford are actually better than most in that they warrant the Mountune upgrade. It is not as agressive as other offerings (and not cheap), but why do people have it? Yep, because it maintains the warranty.
You just need to accept that luck was not on your side and your gamble on a cheaper private sale with mods has not paid off.

He documented the mods for you then? So you have a report from a qualified professional which states what changes have been made, with supporting evidence, and what your failure mode is, again with evidence, and why the two aren't linked, again with, you guessed it, evidence.So basically ford are trying to wriggle from this by saying if its modded then they dont have a do anything but the problem is not caused by the mod and thats fair is it apparently.
