Morning All,
I’m hoping for a bit of advice regarding the deeds to my house. When at my previous property, there was a minor issue with a neighbour regarding the responsibility for a fence. As the property was mortgaged, I applied to the building society, paid a small fee and got to check my deeds. As it was, the fence was my responsibility, so I sorted it and all was well.
Fast forward to my current property. I moved in just after it was completed in 2006. It is in a row of 4 terraced houses, mine being one of the end properties. Attached to my house is a row of three garages, one of which is mine. It is also the only one with mains electricity. I should point out at this point, that the drive to three of the properties, including mine is shared.
I paid off the mortgage on my house in 2019. However, contrary to my expectations, I didn’t receive the deeds on completion. I wasn’t overly concerned about it, but recent events suggest that I might need access to the deeds sooner rather than later, specifically to check wayleaves and easements to my property.
My direct neighbour bought the house about 4 years ago. She lived there for about 18 months then bought a new house with her boyfriend. They currently rent out the house next to me and, as long as the tenants pay on time, they don’t really care about the impact of their tenant’s behaviour on the other neighbours. She has recently suggested that they are thinking about getting an electric car charging point fitted to their property. I have pointed out that, as the driveway is shared, there would be little point in doing so as, if anyone uses it, they will be blocking the access for myself and another neighbour. I have also told her that I am more than happy to give her permission to have electricity put into her garage, provided my driveway is reinstated after the work, however, she doesn’t appear to be too interested in doing this, due to the added expense.
Consequently, can anyone tell me where I should start to get my deeds. I’ve got some information from the land registry, but either I am looking in the wrong place, or it isn’t there. My original mortgage was with the Derbyshire building society, but they were taken over by Nationwide, so would that be my first port of call?

Traditional property deeds are now obsolete and are replaced by the Land Registry title which can be downloaded and usually contains most relevant boundary and covenant information however my previous property built 1992 had a 2 pager at the Land Registry but when we paid off our mortgage the bank sent though a pack of paper docs 2 inches thick and going into land details for the whole estate.I sold 2 properties for probate and the land registry had 2 pages showing boundaries but in the personal effects there were obsolete original deeds going back a century.
It beggars belief that at the time of purchase your conveyancing solicitor did not provide you with everything relevant to boundaries and shared access and it could be worth going back to your solicitor in case they have anything on file.
Thanks for the responses so far guys. Yes, I have been on the land registry website and have got copies of the title plan etc. Sadly, neither document contains the information that I am looking for.
When I checked the deeds to my previous property, they were contained in a thick file, with lots of information going back as far as the purchase details of the land that the house was built on!
There’s not much chance of me getting any information from the conveyancing solicitor unless it is via an Oujia board!
My current property was bought off plan. The things that made the house attractive were, firstly, it is the last house on a cul de sac, so nice and quiet. Secondly, the shared driveway was supposed to be used for, “dropping off and picking up, with no long term parking.” Finally, each house had either, two dedicated parking spaces or one dedicated space and a garage. The neighbour who is the potential problem, tells her tenants that they have two parking spaces AND a garage, so consequently, her tenants end up using the garage for storage and then parking one of their cars on another poor sod’s property and when someone tells them about it, they don’t believe it! Inevitability, her tenants all seem to be crap drivers too, as they don’t seem to be able to reverse off their drive without driving on part of my garden and squishing some of our plants!!!
Consequently, the information regarding wayleaves and easements etc would be incredibly useful for me to have.
