Does receiving a P45 terminate a contract?
Discussion
Hi I was told last Friday that 1 out of the 3 people working in internal sales team will be made redundant and I have a meeting on a week Friday to discuss further.
I am not sure what I am entitled to due to a sabbatical.
I started working with the company in Jan 06. In April 07 I took 7 months off work and went traveling, I had a verbal agreement that they would hire a replacement for me on a temporary contract and I could have my job back in November 07. They sent me my P45 while I was away and once I was back in England my boss phoned me to check that I would be back in work the following Monday. I returned to work and was not issued a new contract.
So my query is does a P45 mean a termination of contract / employment? Will the company look at it from a point of view that I have only been employed since November 07 therefore entitled to nothing. Or would it be that I have been employed since Jan 06 and they will deduct 7 months from my time of employment?
Any advice is welcome I've tried to find info on the .gov websites but nothing seems to cover my situation.
Cheers
Andy

I would put my money on them saying you are not entitled to anything as you have only been employed since November 07.
Ideally you would have had a written agreement before going on sabbatical regarding your status of employment and how that affects continuous employment. The fact that you were issued a P45 would lead to to believe that you do not have this agreement in writing, and that your employer is treating it as two seperate instances of employment.
You need to ask them at your consultation meeting.

Hmm I was worried people were going to say that. I have nothing in writing to say I could have a sabbatical, it was all agreed verbally.
If they count it from when I came back from travelling then that would also mean I don't have a contract and therefore only on a weeks notice.
A colleague from another department doesn't have a contract and she was told she would be on a weeks notice if it was her to go.
