Hello everyone hope you are keeping safe!

New to this forum but I have read a few different topics which have helped me already. Always bought my cars through PCP and this was first PCH deal and I think I have got stuck already (thanks to Covid!)

I have a specific scenario around a pending order car on PCH via Select Car Leasing. I have ordered a car in January which has been been made to order but not received to due it being built in factory and overall supply chain delays. Due to Covid and changing economic circumstances for myself I am thinking not to commit to this deal. I would rather change to a smaller car by purchasing out right as I am now working from home for the near future with less driving.

To confirm:

1) I have signed and paid for the order (£199 admin fee) and I am months past the cooling off period of 14 days
2) Not received the car yet and signed completed financial paperwork with the finance company (that happens on delivery?)

My question is what can I do to not proceed or cancel the deal? What am I am liable for? Losing the admin fee is no big deal at this stage.

I do not wish to call Select Car Leasing until I understand what my possible steps are. Is my view to be honest and tell them where I am in my change is circumstances?

Similar position. In my case it's a pre reg vehicle which is yet to be delivered. Posted on here asking the same as you but in the end I just sent an email asking what my cancellation rights are.

I was told the lease contract commences once I receive the vehicle meaning I can walk away as i am yet to get it. They however said I would lose the admin fee as I am cancelling after 14 days (fair enough). I had already paid the first month's payment and was advised this would be refunded. I need to make a decision tonight - was waiting to hear what Boris Johnson says!

Not sure if yours being factory ordered makes a difference. Hope that helps. I'd just email them and ask.

The contract starts from date of actual delivery and there is a 14 day period to cancel. You will probably lose any admin fee. Always best to check the documentation you have received to be clear of your rights before contacting the lease company.

Both thank you for your responses on this - wasn't able to reply last night as the forum was suspended! A little reassuring but you never know and think its time to be honest the world is completely different place from when I ordered the car in January. Will feedback on what they say. Cheers J

Also in a similar position. Broker unable to provide a delivery date, or even find out whether the car has been built yet.
Ordered in January and wanted delivery in early may. Need a car for work so may have to buy something as unsure when this one will be available. Approached broker with cancellation, but told will have to pay £500+ in charges as well as forfeiting the original fee paid (£360).

Unsure where I stand as haven’t completed any of the finance paperwork yet.. Any pointers gratefully received

Hi All,

I had an honest and frank conversation with the broker and they said if I do not want the car anymore I can simply cancel and refuse delivery. As stated in a earlier response in this thread that is effectively when the financial contract begins. The only penalty is that I will lose my admin fee which as I said is not a huge deal at this stage for a few hundred quid. The car being a standard spec means that they can put it back into the market pretty quickly for sale.

He did provide me an options:

1) to look at another car if I wished to find something within a different budget
2) or pushing out the delivery to a later date (even though we have no idea when it is coming anyway)

I am a little of stuck now because the deal I found (£370 a month for Discovery Sport RDynamic P200 fully maintained servicing and tyres for 36 months + 9 up front) seems like a steal!) but i really don't need another car sitting on my drive for the immediate future while we are stuck at home.

Thanks everyone for the advice and it does feel like best thing to do is pick up the phone and discuss options.

Call them back cancel the order, refuse the vehicle and be prepared to write off the original fee.

I am in a similar position to jgrewal, new to this forum and could do with a bit of advice on the situation. Always bought my cars through PCP and this was first PCH deal.

I have a specific scenario around a car order that I cancelled on PCH via National Vehicle Solutions. I ordered a car in February which was a stock order (timescale 2/3 weeks for delivery), Audi Q5 S Line Plus which was due to be delivered on 31st March 2020, due to Covid there was a delay and did not hear from the leasing company until end of April, due to changing economic circumstances plus we were still in lockdown at that time I was reluctant to have a new car sitting on the driveway not going anywhere. Plus we needed a car at the end of March so I purchased another one at that time from a family member as NVS failed to deliver when they said they would.

To confirm:

1) I have signed and paid for the order (£240 admin fee) and I am months past the cooling off period of 14 days
2) Did not receive the car and signed completed financial paperwork with the finance company

National Vehicle Solutions are threatening me with legal / court action if I don't pay £500 cancellation fee which is set out within their terms and conditions of the order form we signed, please see below. I am waiting for the Financial Ombudsman Service to investigate my complaint against them.

In the event of me/us canceling this order for any reason, other than stated or failing to take delivery within the specified period I/We shall be liable to pay a cancellation fee of £ 500.00 to “National Vehicle Solutions ". In the event of non-payment, you will then become liable for interest and debt collection costs which will be added to the cancellation fee.

My question is am I liable for the £500 cancellation fee as they failed to deliver the vehicle within the specified period?

Hey mate. In the end on mine I did manage to cancel but ordered a different car from the same broker. This meant they were a little more relaxed. However, in all the reading and discussions I had with many people the fact that you

A) the car was never accepted as delivered
B) way later than expected

You should not pay anything extra at worse lose the admin fee. Try stick to your guns!

Thanks for getting back to me with your advice and that I should not pay anything extra - don't have any issues losing the admin fee. I've paid them £300 in £100 instalments over the past 3 months as they were using scare tactics when I cancelled the order at the end of April but have refused to pay the final 2 months and done a chargeback dispute via my credit card company to get the £300 back, probably in hindsight should have stuck to our guns and not paid them anything but were really worried about being taken to court and non payment affecting our credit rating.
